Proposition 64 - Limits on Private Enforcement of Unfair Business Competition Laws (Limits on Lawsuits put Forth by Individuals Against Businesses)
Proposition 64 is an initiative to cut down on frivolous lawsuits against businesses. These are lawsuits that have little weight or importance. In order to do this the initiative limits an individual's right to file a lawsuit only if there is proof of an injury such as financial loss or property loss that resulted from business negligence. Lawsuits that do satisfy this requirement can only be represented by the California Attorney General or local government attorneys. This initiative requires that class action lawsuit procedures be followed in a lawsuit against a business. Limits will also be placed on monetary settlements.
